customer, you and your refer to the purchaser of any goods from us
contract means the contract between you and us for the sale by us to you of goods or services
goods means any goods or services you order from us
order means an order placed by you with us for the purchase of goods by clicking "confirm order" on the checkout page
Terms of the contract
If you place an order for goods, these terms and conditions apply to your order and to the contract between you and us.
We may change these terms and conditions at any time. Any changes will apply to any orders that you place after the time that we update the terms and conditions on our website. The changes will not apply to any order that you place before we make the changes on our website. We have taken care to ensure that our website and these terms and conditions do not contradict each other. However if there are any inconsistencies or contradictions then these terms and conditions shall apply instead of any contradictory or inconsistent part of our website.
When the contract is created No contract exists between you and us until we notify you that we have accepted your order and delivered the goods. We are not obliged to accept your order. We may cancel your order if we cannot supply the goods for any reason.
Payment on our website should be made using the Paypal option, found when checking out. Debit and Credit cards may be used via the Paypal payment gateway.
We require full payment, prior to production, of any goods ordered through our web store (www.candlestickcreative.co.uk/webshop)
Delivery will be made immediately upon completion of the production of your goods. As most goods are only made to order the production time can vary greatly. If you have certain time constraints pertaining to your order then please make this known when you checkout or contact us directly via email or telephone to determine what might be possible.
We will deliver the goods that you order to the delivery address you give when you place your order. If there is no one available to accept the delivery when our courier arrives, the courier will keep the goods for up to two days and you can arrange for a new delivery date.
After two days the courier may return the goods to us whereupon we will keep the goods for 4 weeks, while we attempt to contact you using the contact information you entered at the time of your purchase. After this time we will treat the order as unwanted and cancel your order. Due to the personal and bespoke nature of many of the goods we provide we retain the right to keep payments made for these goods.
If some of the goods you ordered are not available we may deliver part of your order. We will deliver the rest of the order as soon as possible afterwards.
Candlestick Creative retain the right to modify prices from time to time and to apply and remove offers without notice.
Limitation of Liability
Candlestick Creative shall not be held responsible for errors resulting from the customer's failure to communicate specific desired instructions. If an error is construed to be on the part of Candlestick Creative, our liability will be limited to resupplying the goods in question.
We shall not be liable for any failure to perform, or delay in performing, any of our obligations under the contract if and to the extent that the failure or delay is caused by circumstances beyond our control.
Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond reasonable control:
act of God, explosion, flood, tempest, fire or accident;
war, threat of war, sabotage, insurrection, civil disturbance or requisition;
acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;
import or export regulations or embargoes;
strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of Candlestick Creative or of a third party);
difficulty in obtaining materials, labour or machinery; and
power failure or breakdown in machinery
Health & Safety
Candlestick Creative confirms that the goods it supplies as a distributor do not present a hazard to health and safety when;
properly used for the purpose for which they are designed; and
if the Customer takes reasonable and normal precautions in their use.
Candlestick Creative makes every effort to supply the goods as shown/advertised on our website, but reserves the right to supply goods subject to minor variations in actual dimensions and specifications.
As each job is produced to order, once payment has been cleared and the production process started orders cannot be cancelled. If however you are aware of a problem with the order you have placed please contact us as soon as possible so we are aware.
Should find fault with your product please contact us no later than 7 working days after receipt of your goods. We will be happy to replace your product at no additional cost.
When you return goods to us for any reason (for example because you have cancelled the contract under the Distance Selling Regulations or because you think they are defective goods):
you must ensure that they are properly and securely packaged and labelled with our address;
you are always responsible for any damage in transit that is due to incorrect or inadequate packaging by you; and
you are responsible for any damage or loss in transit where you arrange the transport
If you cancel the contract under the Distance Selling Regulations, you must take reasonable care of the goods from the time you receive them until you return them to us. If you cancel the contract under the Distance Selling Regulations you must return the goods to us at your own expense. If you cancel the contract under the Distance Selling Regulations and do not return the goods as required, we may charge you our direct costs of recovering the goods.
You may not cancel the contract under the Distance Selling Regulations if the goods you ordered are customer specified. E.g. Canvas prints made to order.
Faulty goods In these terms and conditions, faulty goods means any goods we supply to you that do not conform to the contract. Faulty goods does not include any goods that are faulty due to fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than in accordance with their intended use, failure to follow the manufacturer's or our instructions, or any alteration or repair carried out without the prior approval of us or the manufacturer. You should notify us as soon as possible if you discover that any goods are faulty goods.
If you return goods because you think they are faulty goods, we may charge you the cost of all transport and our actual costs and expenses in the event that the goods are not in fact faulty goods.
We reserve the right to add on any third party costs that we may incur if invoices are not paid according to our terms i.e. 30 days.
By placing an order with Candlestick Creative you agree fully to our terms and conditions, also;
you agree to indemnify Candlestick Creative and keep Candlestick Creative indemnified against any claims, liabilities, losses and expenses arising out of any misuse of an images supplied to Candlestick Creative for the purpose of reproduction.
We are committed to maintaining the privacy of our customers. As such any data we collect from you will be governed by the provisions of the Data Protection Act (1998).
We only use your data for our own marketing and research purposes and will never sell or pass your personal data on.
